HART COUNTY BOARD OF COMMISSIONERS

The Hart County Board of Commissioners met January 9th, 2001 at 5:30 p.m. in the Hart County Administrative & Emergency Services Center.

 

Vice-Chairman R. C. Oglesby presided with Commissioners Randy Banister, Ken Brown, Don Burdick and Joey Dorsey in attendance.

 

Call to Order, Welcome, Moment of Silence

 

Vice-Chairman Oglesby called the meeting to order, welcomed those in attendance and called for a moment of silence.

 

Vice-Chairman Oglesby then turned the chairmanship election over to County Administrator Gary Cobb.

 

Commissioner Dorsey entered a motion to nominate Commissioner Oglesby as chairman for the year 2001. Commissioner Brown provided a second to the motion. The motion carried 3-0. Vice-Chairman Oglesby and Commissioner Burdick abstained from voting.

 

Commissioner Banister entered a motion to nominate Commissioner Burdick for vice-chairman. Commissioner Dorsey provided a second to the motion. The motion carried 3-0. Chairman Oglesby and Commissioner Burdick abstained from voting.

 

Approval Agenda

 

Commissioner Brown entered a motion to move New Business items e & f to the Consent Agenda and approve the meeting agenda. Commissioner Dorsey provided a second to the motion. The motion carried unanimously. The meeting agenda is recorded in the “2000-2001” minutes book.

 

Approval of minutes of previous meeting(s)

            12/11th, 12/12th, 12/15th, 12/29th ‘00

 

Commissioner Brown entered a motion to approve the minutes of the meetings held December 11th, 12th, 15th, and 29th’ 00. Commissioner Banister provided a second to the motion. The motion carried unanimously.

 

Remarks by Invited Guests, Committees, Authorities, Etc.

a.                  Tom Mullenix, Director DFACS

 

Tom Mullenix, Director of Hart County DFACS, gave a report of the various programs offered through the local office as follows:

·        Transportation program which has been very effective for the low income programs

·        Food Stamp program has dropped 25% over the past three years

·        Social Services averaged 82 cases per month in 2000

·        Foster home program is in need of more volunteers

·        Medicaid program continues to increase

 

Mr. Mullenix reported that the Welfare Reform Act of 1997 has accomplished what it is meant to do. He said the caseload has decreased from 320-330 cases to 124 cases currently. 

 

Commissioner Burdick asked if Mr. Mullenix has data on the Medicaid program. He said over the past five years the program has increased 155% and 211% for patients in nursing homes.

 

Mr. Mullenix thanked the board for the county’s support and their new facility.

County Administrator’s Report

 

County Administrator Gary Cobb reported the county’s recycling program has met State Solid Waste reduction requirements by reducing the amount of trash being hauled outside the county to a landfill. He also reported the recycling program generated 1.86 million pounds, of which the county collected two cents per ton for a total of $38,800. He said the program is worthy of the effort it takes to recycle.

 

Commissioner Burdick remarked that the county met the required 25% reduction of solid waste.

Consent Agenda

a.                  Resolution to re-finance E911 system

Commissioner Burdick entered a motion to approve the Consent Agenda. Commissioner Brown provided a second to the motion. The motion carried unanimously. The Consent Agenda is recorded in the “2000-2001” minutes book.

 

Old Business

a.                  2nd Reading, Amendments to Chapter 34 Environment

 

Greg Oglesby read the amendments to the Chapter 34 Environment pertaining to soil erosion control. He said the changes were brought about to comply with state mandates.

 

New Business

 

Commissioner Burdick suggested that the board proceed with the public hearing.

 

b.                  Public Hearing, Amendments to Chapter 34, Environment

 

County Attorney Walter Gordon remarked that the Soil Erosion & Sediment Control program in 1975 requirements included exempting agriculture, timbering operations and the Department of Transportation.

 

Virgil Ayers questioned the buffer zone for agriculture. Attorney Gordon stated there is an exemption for most agricultural operations.

 

Al Olsen asked if the county is going to get involved in NPDES permits. Greg Oglesby responded that the EPD would handle NPDES permits.

 

 

            a.         Beer & wine license renewal/Wilson Yeast – Hickory Crossing Gro.

 

Commissioner Brown entered a motion to renew the beer and wine license to Mr. Yeast. Commissioner Dorsey provided a second to the motion. The motion carried unanimously.

 

c.                  Action on Amendment to Chapter 34

 

Commissioner Brown entered a motion to adopt the Amendments to Chapter 34 Environment Ordinance. Commissioner Burdick provided a second to the motion. The motion carried unanimously.

 

d.                  Bid Opening - Tax Assessor Service

 

The following companies presented bids for professional services to access personal property:

                        Traylor Business Services   $43,296                                 

                        Mendola                                 $44,955

                        Tax Management Assoc. did not present a total bid in their proposal

 

Commissioner Burdick entered a motion to have the County Administrator review the bids received and make a recommendation to the board. Commissioner Brown provided a second to the motion. The motion carried unanimously.

 

g.         Arcade License/Borderline Sports Grill    

 

h.                  Arcade License/Borderline Bait & Tackle

 

i.          Arcade License/Borderline Trading Post

 

County Administrator Cobb presented a spreadsheet summary of arcade license applications received as of August 2000. The spreadsheet summary is recorded in the "2000-2001" minutes book.

 

Commissioner Burdick remarked that unlike other establishments in the county there are no pending charges against the owners or operators of Borderline Sports Grill, Borderline Bait & Tackle or Borderline Trading Post.

 

Administrator Cobb reported that background checks were run through SLED since the applicants were from South Carolina.

 

Commissioner Burdick entered a motion to grant an arcade license to Borderline Sports Grill, Borderline Bait & Tackle and Borderline Trading Post. Commissioner Brown provided a second to the motion. The motion was open for discussion.

 

Commissioner Banister remarked that as a point of record that there was a tremendous outcry from residents in the Sardis community opposing video arcades. He reminded the owners of the three establishments to comply with the local arcade ordinance.

 

The vote carried unanimously.

 

Public Comment

 

Virgil Ayers remarked that with a new year beginning and two new members on the board that he is looking for more open government. He asked that they read the Sunshine Law of 1999. He said he wanted the board to restore faith and confidence to Hart County residents. He quoted “ with the seeds you sow, that sometime you will have to harvest”.

 

Mr. Ayers also requested that the board re-visit four-way stop signs.

 

Herb Emmel requested that the board talk into the microphones. He said he had difficulty hearing them.
