The Hart County Board of Commissioners met May 22nd, 2001 at 7:00 p.m. in the Hart County Administrative & Emergency Services Center.

 

Chairman R. C. Oglesby presided with Commissioners Randy Banister, Ken Brown, Don Burdick and Joey Dorsey in attendance.

 

Call to Order, Welcome, Moment of Silence

 

Chairman Oglesby called the meeting to order, welcomed those in attendance and called for a moment of silence.

 

Approve Agenda

 

Commissioner Burdick entered a motion to amend New Business item f. to Public Health Ordinance - On site sewage management, add i. LARP, j. Subdivision - Ward & Cassandra Rounsaville, k. Subdivision - Susan Redd Bingham and to adopt the agenda. Commissioner Dorsey provided a second to the motion. The motion carried unanimously. The agenda is recorded in the minutes book.

 

Approve Minutes of Previous Meeting(s)

            05/08th, 05/15th, 05/16th, 05/18th '01

 

Commissioner Banister entered a motion to approve the minutes of the meetings held May 8th, 15th, 16th, 18th '01. Commissioner Dorsey provided a second to the motion. The motion carried unanimously.

 

Remarks by Invited Guests, Committees, Authorities, Etc.

None

 

Reports By Constitutional Officers & Department Heads

 

County Attorney Walter Gordon reported that the Water & Sewer Utility Authority is testing water lines on the highway 29N project and will begin installing meters soon.

 

County Administrator's Report

 

County Administrator Gary Cobb announced the county has been awarded a $50,000 grant for the Solid Waste Department.

 

Chairman's Report

 

Chairman Oglesby reported the following upcoming meetings:

·        DOT annual meeting June 20th, 2:00 p.m. - Hart County Library

·        Carl Puckett representing the ISO will be here May 23rd, 12 noon

 

He also reported that E. R. Snell Construction Company has offered to reimburse the county $29,335 for asphalt purchased from the Elberton asphalt plant.

 

Commissioner Banister entered a motion to authorize the Chairman to execute the contract with E. R. Snell after review from the County Attorney. Commissioner Burdick provided a second to the motion. The motion carried unanimously.

 

Commissioners' Reports

 

Commissioner Burdick announced that it has been brought to his attention that there are three video arcade establishments that have not gotten their paperwork in order. He said a letter has been mailed to inform the operators that they must comply with the county's video arcade ordinance.

 

Commissioner Dorsey reported that the intersection of Bethany-Bowersville and Airline-Goldmine Road is a dangerous intersection.  Commissioner Brown entered a motion to install rumble strips at the intersection. Commissioner Banister provided a second to the motion. The motion carried unanimously.

New Business

 

a.                  Public Defender FY'02 budget

 

Commissioner Dorsey entered a motion to approve the Public Defender budget request in the amount of $46,758. Commissioner Brown provided a second to the motion. The motion carried unanimously. 

 

b.                  Contract - Michael White (Public Defender)

 

Commissioner Banister entered a motion to approve the Public Defender Contract. Commissioner Dorsey provided a second to the motion. The motion carried unanimously.  The contract is recorded in the "2001-2002" minutes book.

 

c.                  Solid Waste Disposal Service Contract

 

County Administrator Gary Cobb reported that Waste Management has offered to extend the current hauling contract until 2004 with an annual maximum increase of 3%.

 

d.                  Public Health Ordinance - Swimming Pools

e.                  Public Health Ordinance - Tourist Accommodations

f.                    Public Health Ordinance - On Site Sewage Management

 

Dr. Charles Lattuada reported that the Board of Health has passed rules and regulations for the above ordinances. Dr. Lattuada recommended the board adopt the ordinances so any violations could be enforced at the Magistrate Court level.

           

County Administrator Cobb recommended that the board proceed with two readings of the above ordinances prior to adopting them.

 

g.                  Wetlands Ordinance

 

County Administrator Cobb recommended the board review the Wetlands Ordinance which has to be adopted by October 1st,'01.

 

h.                  FY'02 DFACS Lease

 

Commissioner Burdick entered a motion to adopt the annual DFACS lease agreement. Commissioner Brown provided a second to the motion. The motion carried unanimously. The lease agreement is recorded in the "2001-2002" minutes book.

 

i.                    LARP

 

Commissioner Brown entered a motion for Griffin Road and Reed Creek Road to be submitted on the LARP list. Commissioner Banister provided a second to the motion. The motion carried unanimously.

 

j.                     Subdivision - Ward & Cassandra Rounsaville

 

Commissioner Brown entered a motion to approve the subdivision request. Commissioner Dorsey provided a second to the motion. The motion carried unanimously.

 

k.                  Subdivision - Susan Reed Bingham

 

Commissioner Banister entered a motion to approve the subdivision request. Commissioner Dorsey provided a second to the motion. The motion carried unanimously.

 

Public Comment 

a.                  Mohammed Jalil

 

Mr. Jalil was not in attendance.

 

Al Olsen representing the NE Georgia Homebuilders Assoc. stated that he would be willing to work with the county on Land Use and Development Ordinances to prevent any future problems that may arise.

 

Attorney Dan Strickland, representing Freddie Cagle, requested that the board allow Mr. Cagle to continue operating his video arcade establishment while the license process is being considered. He said that Mr. Cagle relied on public information he was given at the onset of his application. However, Mr. Cagle was later notified that his application was incomplete.
