The Hart County Board of Commissioners met October 23rd, 2001 at 7:00 p.m. in the Hart County Administrative & Emergency Services Center.

 

Chairman R. C. Oglesby presided with Commissioners Randy Banister, Ken Brown, Don Burdick and Joey Dorsey.

 

Commissioner Burdick entered a motion to amend the agenda to add October 18th, 2001 minutes and a salary change for Deputy Chris Royal. Commissioner Banister provided a second to the motion. The motion carried 5-0.

 

Commissioner Brown entered a motion to approve the minutes of the meetings held October 9th, 15th and 18th, 2001. Commissioner Burdick provided a second to the motion. The motion carried 5-0.

 

Remarks by Invited Guests, Committees, Authorities, Etc.

 

None

 

Reports By Constitutional Officers & Department Heads

 

County Attorney Walter Gordon reported that the North & South school water line project is virtually complete and commended the contractor for the excellent job installing the water lines.

 

Attorney Gordon reported that he has discussed the ownership of the water lines along Highway 29S, Highway 172 and CR507 with the City of Hartwell's attorney. He recommended that the not file the lawsuit against the City at this time. He said the Hart County Water & Sewer Utility Authority and the City of Hartwell are in the process of working out an agreement.

 

County Administrator's Report

 

County Administrator Gary Cobb reported the following:

 

·        The goal for cutting over to the new 911 system is scheduled for Wednesday, October 24th, 2001.

·        The Clean & Beautiful Recognition is scheduled for November 15th, 2001 at the Senior Center.

·        Drug Free-red ribbon ceremony October 26, 2001 at 9:45 a.m. @ Veterans Stadium.

·        County is arranging for employees to take the flu shot for $10 cost to the individual.

 

 Chairman's Report

 

Chairman Oglesby announced that a Veteran's Day ceremony would be conducted on the courthouse lawn November 12th, 2001.

 

Chairman Oglesby recognized and presented a plaque to District # 2 Commissioner Don Burdick for completing the course requirements for Certified County Commissioner.

a.                  Recreation Advisory Board Appointment

 

Chairman Oglesby entered a motion to appoint Derek Cobb to the Recreation Advisory Board. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

 

b.                  FY02 Personal Property Audit

 

Chief Tax Assessor, Margaret Crossley, requested the Board extend the contract with Mendola & Associates for the purpose of auditing personal property for commercial businesses in the county at a cost of $25,000. She explained that there is a provision in the law that allows the county and the Board of Education to make available funds for audit purposes.

 

The board concurred that the Board of Education consider paying a portion of the audit fee since the greatest portion of revenues collected go to them. Board of Education Finance Director, Lonnie Burns, said that if everything were fine with the attorneys he wouldn't have a problem with the request. Mr. Burns asked for the figures from last year's audit to present it to the Board of Education members.

 

Commissioner Burdick entered a motion to approve extending Mendola & Associates contract contingent on the Board of Education's participation. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

 

c.                  Silver Dollar d.b.a. Lakeside Lottery/Arcade Ordinance

 

County Attorney Gordon addressed the issue of Freddie Cagle was cited October 12th, 2001 for having more than three video arcade machines operating at Lakeside Lottery. He explained that Mr. Cagle is currently the plaintiff in two court cases against the county. One case is to invalidate the ordinance that limits the number of machines in an establishment and the second one is to compel the board to issue him an arcade license.

 

He also explained that the Hart County Magistrate Court would hear the case. He said the county ordinance provides for a general penalty of up to a $1,000 fine and 60 days in jail, the revocation of any and all other county licenses, and revocation of machine licenses.

 

After much discussion on the issue, Commissioner Burdick entered a motion to request the Magistrate Judge move expeditiously to hear the case, and if found guilty to revoke registration of machines at both locations owned by Mr. Cagle. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

 

d.                  Economic Development Corp Appointment

 

Commissioner Banister entered a motion to table the appointment and place it on the next meeting agenda. Commissioner Burdick provided a second to the motion. The motion carried 5-0.

 

e.                  Pay grade - Deputy Chris Royal

 

Chairman Oglesby entered a motion to credit Deputy Royal with three years direct applicable experience to be used in determining his salary. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

Executive Session

 

a.                  Personnel Matters & Pending litigation

 

Commissioner Dorsey entered a motion to exit into executive session as required by O.C.G.A. 50-14-2, 50-14-3, and 50-14-4(b) to discuss personnel matters and pending litigation. Commissioner Brown provided a second to the motion. The motion carried 5-0. The Resolution and affidavit is recorded in the "2001-2002" minutes book.

Commissioner Dorsey entered a motion to adjourn the meeting. Commissioner Brown provided a second to the motion. The motion carried 5-0.
