The Hart County Board of Commissioners met October 3rd, 2001 at 12 noon in the Hart County Administrative & Emergency Services Center.

 

Chairman R. C. Oglesby presided with Commissioners Randy Banister, Ken Brown and Joey Dorsey in attendance.  Commissioner Don Burdick absent.

 

Also in attendance were members of the Water & Sewer Utility Authority, Chairman Fort Oglesby, Jerry Cleveland, Pat Goran, Larry Haley and Jere Johnson.

 

Chairman Oglesby called the meeting to order and announced the purpose of the meeting was to discuss legal issues and personnel matters.

 

Commissioner Dorsey entered a motion to exit into executive session to discuss litigation matters as required by O.C.G.A. 50-14-2, 50-14-3 and 50-14-4(b). Commissioner Banister provided a second to the motion. The motion carried 4-0. The resolution and affidavit are recorded in the "2001-2002" minutes book.

 

In a joint session with the Water & Sewer Utility Authority the boards discussed the ownership of the waterlines on Hwy29S, Hwy172 and CR507.  County Attorney Walter Gordon explained that the City of Hartwell and the county received a HUD grant in 1979 in the amount of $703,000 to provide water in the unincorporated areas of the county. He also presented a copy of a signed agreement from both entities that gave details of ownership of the water lines etc.

 

Commissioner Banister entered a motion to exit executive session and convene the meeting. Commissioner Dorsey provided a second to the motion. The motion carried unanimously.

 

Commissioner Brown entered a motion to authorize Attorney Gordon to file a lawsuit against the City of Hartwell in the name of Hart County Board of Commissioners and Hart County Water & Sewer Utility Authority claiming ownership of the waterlines. Commissioner Dorsey provided a second to the motion. The motion carried 4-0.

 

The Water & Sewer Utility Authority members exited the meeting.

 

Commissioner Brown entered a motion to exit into executive session to discuss personnel matters as required by O.C.G.A. 50-14-2, 50-14-3 and 50-14-4(b). Commissioner Dorsey provided a second to the motion. The motion carried 4-0.

 

With no further action taken during executive session, Commissioner Brown entered a motion to exit executive session and adjourn the meeting. Commissioner Dorsey provided a second to the motion. The motion carried 4-0.
