The Hart County Board of Commissioners met May 10th, 2005 at 5:30 p.m. in the Hart County Administrative & Emergency Services Center.

 

Chairman R C Oglesby presided with Commissioners Daniel Reyen, Gary Mize, Ricky Carter and Joey Dorsey in attendance.

 

  1. Call to Order  

Chairman Oglesby called the meeting to order.

 

  1. Welcome

Chairman Oglesby welcomed those in attendance.

 

  1. Prayer

Prayer was offered by Deacon Cordell of Sacred Heart Catholic Church.

 

  1. Pledge of Allegiance 

Everyone stood in observance of the Pledge of Allegiance.

 

  1. Approve Agenda 

Commissioner Carter entertained a motion to add New Business item e) Public hearing Beer & Wine Application - Royal Food Store. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

 

Commissioner Reyen entertained a motion to approve the agenda. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

Commissioner Dorsey entertained a motion to approve the minutes of the meetings held April 26th and April 28th, 2005. Chairman Oglesby provided a second to the motion. The motion carried 5-0.

  1. Reports by Constitutional Officers & Department Heads 

None

 

  1. County Administrator's Report  

County Administrator Jon Caime reported that the Road Department is spreading a layer of sand on the tar and gravel roads in order to create better riding conditions. He invited the BOC members to Andrew Floyd Road site where this method has just been completed.

 

Administrator Caime announced that the DOT will meet at the Administrative Building May 24th, 2005 at 1:00 p.m. for their annual STIP; SPLOST II funds have reimbursed General Fund for the fire trucks that were purchased in FY'04; Tax Assessor Robert Wesley's term will expire December 31, 2006.

 

Commissioner Reyen entertained a motion to approve Mr. Wesley's term to expire December 31, 2006. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

 

Administrator Caime announced that Pharma Tech Industries has agreed to purchase the Johnson & Johnson plant and offered employment to at least 130 of J&J employees.

 

He reported that the county staff has completed their research on cushions for the pews in the meeting area.

 

Chairman Oglesby entertained a motion install permanent cushions. Commissioner Dorsey provided a second to the motion. The motion carried 4-1. (Commissioner Reyen opposed)

 

Administrator Caime gave an update on the bush hog project, noting that the county has received compliments on the current contractor's performance.

 

He reminded the BOC of their decision to appoint individuals to a Courthouse Committee. He ended his report with a summary of the Economic Development Summit that was held in Atlanta May 2nd, 2005.

  1. Commissioners' Reports

Commissioner Carter commended County Administrator Caime and Economic Developer Bob Evans for their efforts.

 

Commissioner Dorsey entertained a motion to draft a letter to State Representative Alan Powell and Senator Nancy Schaeffer to request his support to waive the Department of Corrections request for county funds for the Whitworth Parole Center's work detail. Commissioner Carter provided a second to the motion. The motion carried 5-0.

  1. Old Business 

a)      Courthouse Security Budget Amendment

Commissioner Reyen entertained a motion to amend the General Fund budget by $20,000 for security items for the courthouse. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

 

Commissioner Reyen entertained a motion to direct County Attorney Gordon to draft a letter to Representative Powell and Senator Schaeffer establishing who's responsible for the courthouse security. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

 

  1. New Business

a)      Bridge Crossing Report  

County Administrator Caime presented a report on dangerous bridge crossing on county maintained roads. He noted that 60% of the county's inventory of bridges is in need of repair. He noted that the Road Department has accomplished some of the repairs that were listed on a 5 year plan that was developed in 2003.

 

b)      Annexation Agreement-Rec. Park  

After discussing the proposed annexation agreement, Commissioner Reyen entertained a motion to not execute the agreement. Commissioner Carter provided a second to the motion. The motion carried 5-0.

 

Commissioner Dorsey entertained a motion to allow the Chairman and the County Administrator to meet with the Mayor and the City Manager to try to work out an agreement. Commissioner Reyen provided a second to the motion. Commissioner Carter noted that if an agreement could not be satisfied in two weeks that the county proceeds with requesting the Water & Sewer Utility Authority to supply water to the new Recreation Park. The vote carried 5-0.

 

c)      Armed Forces Day Proclamation  

Commissioner Reyen entertained a motion to adopt the Armed Forces Day Proclamation. Commissioner Dorsey provided a second to the motion. The motion carried 5-0.

 

d)      BOA Chairman Report 

Chairman of the BOA was not present. Commissioner Dorsey entertained a motion to send a letter to the Chairman of the BOA inviting him to the May 24th, 2005 meeting.

 

e)      Public Hearing Beer & Wine Application - Hameed Somani

County Attorney Gordon noted that the time frame for the beer & wine applicant's appeal for a hearing is within the guidelines. He turned the hearing over to Attorney Gene Harper.

 

Attorney Harper noted that his client did not understand the question on the Beer & Wine application concerning citizenship to the State of Georgia. He explained that Mr. Somani is the current owner of the establishment and is appealing to the BOC for a beer & wine license. He presented documentation of proof of ownership and citizenship of the State.

 

After discussing the matter at length, Chairman Oglesby entertained a motion to approve Mr. Somani's beer & wine application. Commissioner Dorsey provided a second to the motion. The motion carried 3-2. (Commissioners Mize and Carter opposed)

 

  1. Public Comment 

None

 

  1. Executive Session - Litigation  

Commissioner Dorsey entertained a motion to exit into Executive Session to discuss litigation matters. Commissioner Reyen provided a second to the motion. The motion carried 5-0.  The affidavit & resolution is recorded in the minutes book.

 

With no further action taken during Executive Session, Commissioner Reyen entertained a motion to exit Executive Session. Commissioner Carter provided a second to the motion. The motion carried 5-0.

 

  1. Adjournment  

Commissioner Dorsey entertained a motion to adjourn the meeting. Commissioner Reyen provided a second to the motion. The motion carried 5-0.
