LAND IN UNINCORPORATED HART COUNTY

IMPORTANT:  This information is provided only as general guidance for the process to comply with County ordinances.  You are responsible for reading, comprehending and meeting all requirements of all applicable laws.

 

    

 

General Information and Guidance:

 

1.      Subdivision of land is generally covered in Chapter 46 of the Hart County Code of

      ordinances.

2.      If the proposed subdivision is more than 5 lots see “Guidance Sheet #2” and do not follow this sheet (#4).

3.      If the subdivision is proposed to have a new public water distribution system and/or new or improved streets and/or is within 500 feet of a sewer system, see “Guidance Sheet #2” and do not follow this sheet (#4).

 

 

Exclusions from Compliance With Chapter 46:

 

General Information:  Certain division of Land is exempt from the requirements of Chapter 46.  A subdivision plat must still be submitted to the County prior to being recorded.  Specific exemptions excluded from Chapter 46 are generally:

 

a)      Combining  previously platted lots where the total number of lots is not increased and the resultant lots are equal to the standards of chapter 46.

b)      Dividing land where no new street or change in an existing street is involved, no utility improvements are required, and no new sanitary sewer or septic system approval is required.

c)      Dividing land into parcels of ten acres or more where no new street or change in existing street is involved.

d)      Divided land into five (5) or fewer parcels, each parcel being two (2) or more acres, and each parcel is deeded to a member of the owner’s immediate family (owners’ spouse, mother, father, brother, sister, children.)

 


 

General Process for Compliance With Chapter 46

 

1.      Preapprovals:

a)      It is highly recommended that a preliminary plat be submitted to the County for comment first.

b)      Approval of the water supply and sewage plan is required from Health Department.

 

2.      Plat Review Process:

a)      The general plat requirements are checked for compliance with Chapter 46.  These are typical plat formats that are normally known by a registered surveyor that will prepare the plat.

b)      The individual lots are reviewed for compliance with Chpt. 46, including setback requirements, adequate building sites, lot lines, 60 foot road frontage (or 30 foot at cul-de-sac) and a prohibition on “flag” lots.
